WAIVER & RELEASE

1. ACTIVITIES COVERED / ACTIVIDADES CUBIERTAS

Wynwood Arena LLC ("Wynwood Arena," "we," "us," or "our") offers various recreational and sports activities including but not limited to: soccer (fútbol), padel, birthday parties, private events, arcade games, glow-in-the-dark activities, dodgeball, laser tag, field rentals, bar and lounge services, and other similar recreational and entertainment activities (collectively, the "Activities").

Wynwood Arena LLC ofrece diversas actividades recreativas y deportivas que incluyen, entre otras: fútbol (soccer), pádel, fiestas de cumpleaños, eventos privados, juegos de arcade, actividades que brillan en la oscuridad, dodgeball, laser tag, alquiler de canchas, servicios de bar y lounge, y otras actividades recreativas y de entretenimiento similares.

2. PARTICIPANT ELIGIBILITY / ELEGIBILIDAD DEL PARTICIPANTE

You must be at least 18 years of age to accept this waiver. Participants under 18 years of age must have a parent or legal guardian complete a separate waiver in person at Wynwood Arena before participating.

Debe tener al menos 18 años de edad para aceptar esta renuncia. Los participantes menores de 18 años deben tener un padre o tutor legal que complete una renuncia por separado en persona en Wynwood Arena antes de participar.

3. WAIVER, RELEASE, AND DISCHARGE OF LIABILITY

I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, HEREBY RELEASE, WAIVE, DISCHARGE, AND HOLD HARMLESS Wynwood Arena LLC, its owners, officers, directors, members, managers, employees, agents, volunteers, representatives, independent contractors, affiliates, successors, assigns, event holders, event directors, event coordinators, event sponsors, event staff, event volunteers, property owners, landlords, and all other persons or entities acting on their behalf (collectively, the "Released Parties"), WITH RESPECT TO ANY AND ALL CLAIMS, LIABILITIES, SUITS, DEMANDS, CAUSES OF ACTION, OR EXPENSES (INCLUDING ATTORNEYS' FEES AND COSTS) FOR ANY INJURY, DEATH, DISABILITY, DAMAGE, OR LOSS TO MY PERSON OR PROPERTY, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE, to the fullest extent permitted by law.

4. INDEMNIFICATION / INDEMNIZACIÓN

I AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from and against any and all claims, liabilities, damages, losses, or expenses (including attorneys' fees) arising out of or resulting from my participation in the Activities, including but not limited to claims made by third parties arising from my actions or omissions.

5. ASSUMPTION OF RISKS / ASUNCIÓN DE RIESGOS

I acknowledge and understand that the Activities involve inherent and other risks of SERIOUS INJURY AND DEATH. I KNOWINGLY AND VOLUNTARILY ASSUME ALL RISKS associated with participation in the Activities, whether known or unknown, including but not limited to:

• Injuries from executing strenuous and demanding physical techniques
• Injuries from turf, grass, artificial surfaces, and playing fields
• Injuries from collisions with walls, structures, goals, equipment, or other participants
• Spinal cord injuries which may result in permanent paralysis or death
• Injuries from weather conditions including heat stroke, dehydration
• Injuries from exposure to communicable diseases including COVID-19
• Injuries arising from the reckless or negligent conduct of other participants

6. ALCOHOL CONSUMPTION / CONSUMO DE ALCOHOL

I acknowledge that alcoholic beverages may be served and consumed on the premises. I understand and voluntarily assume all risks associated with the consumption of alcohol while on the premises or participating in Activities. Wynwood Arena has the right to refuse service or remove me from the premises if I appear intoxicated or pose a safety risk.

7. MEDICAL FITNESS AND TREATMENT

I certify that I am physically fit and mentally capable to participate in the Activities. In the event of injury, accident, or illness, I consent to receive medical treatment deemed necessary. I acknowledge that Wynwood Arena does not provide medical insurance for participants.

8. PHOTOGRAPH AND VIDEO RELEASE

By participating in the Activities, I grant Wynwood Arena LLC the irrevocable, perpetual, worldwide, royalty-free right to use, reproduce, modify, and distribute photographs, videos, and other media capturing my likeness for promotional, marketing, and commercial purposes.

9. GOVERNING LAW AND VENUE

This Agreement shall be governed by the laws of the State of Florida. Any legal action shall be instituted exclusively in the state or federal courts located in Miami-Dade County, Florida.
